A November wreck involving an overturned cargo truck was allegedly the result of road rage. Fortunately, the driver of the overturned truck was not hurt. The Mississippi Highway Patrol is investigating the crash. A co-worker of the driver of the overturned vehicle claims another truck driver cut his co-worker off, causing the crash. The wreck happened just south of Terry, on Interstate 55.

Road rage accidents can be dangerous and even deadly, especially when one or more of the vehicles involved is a large truck. Truck drivers are trained professionals. They are responsible for operating their large vehicles safely in all kinds of road and weather conditions, as well as in traffic. When a truck driver loses their ability to continue driving safely even while they are experiencing anger or other negative emotions, there is a danger to the public as well as to the truck driver.

In 2016, a woman died in a trucking accident that has been attributed to road rage. The facts that describe the scenario that led up to the fatal wreck are shocking because many people are unaware that such things occur on America’s highways. Three trucks belonging to one company were traveling between Salt Lake City, Utah, and Eugene, Oregon. As they traveled, they encountered an RV. The RV is owned by another transportation company and was driven by a professional driver who holds a CDL license. Before the fatal crash, the three truck drivers and the driver of the RV had engaged in a perilous cat-and-mouse game on a two-lane highway. All four drivers were cutting each other off, driving aggressively, braking sharply, and passing each other, even in areas where passing was prohibited. In fact, in the seconds before the collision, one of the truck drivers attempted to pass the RV in a no-passing zone. When the truck driver realized there was a car approaching, he tried to return to the lane where he had been traveling. The driver of the RV maneuvered his vehicle in a way that prohibited the truck driver from moving back into the lane. The truck driver struck the car head-on, killing a woman and severely injuring her husband.

The two trucking companies whose vehicles were involved in the wreck and their drivers faced severe penalties as the result of the deadly crash. A judge recently upheld the jury’s award to the woman’s family, which exceeds twenty-six million dollars, and one of the truck drivers involved in the fatal collision pleaded guilty to second-degree manslaughter.

Truck drivers, like all drivers, must follow the rules of the road and operate their vehicles safely. If you were injured in a road rage trucking accident or a family member lost their life, you might be able to file a claim for the damages that you and your family have experienced in connection with the accident. A tragic chain of events resulted in a fatal motor vehicle wreck involving an eighteen-wheeler and three other vehicles. The pile-up happened on the southbound side of I-270 just south of Clayton. After the accident, the southbound lanes of the highway were closed for over six hours, as multiple agencies worked to remove the wreckage from the roadway and investigate the accident.

A pile-up, or chain reaction accident occurs when one accident or collision occurs and then other vehicles subsequently become ensnared in it. For example, in this recent pile-up accident, the initial incident took place when the driver of a van that was pulling a trailer lost control of their vehicle while they were driving southbound on I-270. As the driver of the van lost control of the vehicle, it crossed lanes, colliding with a tow truck and then a passenger car. During this collision, one or more of the vehicles ended up in the median. At some point during or after that accident, the driver of a tractor-trailer tried to avoid the wreckage. That eighteen-wheeler became entangled in the mess because, despite their efforts, the driver was unable to successfully maneuver around it. Things got worse when the van caught fire, and things continued to get worse when the semi-truck caught on fire. Four people were involved in this devastating and destructive four-vehicle chain reaction crash. One died, two others received serious injuries, and one, the driver of the tow truck, escaped from the experience without harm.

All motor vehicle accidents are tragic, especially those that claim one or more lives and cause large amounts of injury and property damage. Fortunately, drivers can sometimes avoid becoming ensnared in a pile-up accident by employing safe driving strategies. One such strategy is maintaining a constant awareness of the weather and the road conditions where you are driving. We all know that weather is changeable, but did you know that road conditions can change just as quickly as the weather? In fact, some of the most dangerous road conditions can occur right after a change from dry to wet weather, partly because of how the precipitation affects the road surface and partly because drivers are often slow to adjust their driving to variations in the weather. If you reduce your speed as soon as you notice a change in the weather, you will put yourself at an advantage by being able to better maintain control of your vehicle and being better able to see what is happening on the road ahead of you with enough time to safely adjust your course if needed. A second safe driving practice that can help you avoid accidents of all kinds, including chain reaction accidents, is leaving plenty of room between your vehicle and the other vehicles that are near you on the roadway. Space provides time within which you can react to changes in the positions of other vehicles, and can give you enough time to stop or change course safely if a vehicle ahead of you loses control or has a collision.

A recent series of accidents involving multiple tractor trailers is illustrative of the amount of devastation that can occur when more than one of these massive vehicles is involved in a wreck. This particular accident sent three truck drivers to the hospital with minor injuries after a series of events resulted in a total of three tractor trailers becoming involved in the mess.

Accidents like this one, which involve multiple collisions, are often referred to as chain reaction accidents. This particular accident started when an eighteen-wheeler loaded with bricks crossed the median on I-22. As it crossed the median, the truck broke through the cable style guardrail and crossed the other side of the highway, dragging the guardrail cables with it, until it finally came to rest in the woods. This event left the guardrail cables on the road, where another tractor trailer became entangled in them and subsequently veered into the median.

The second truck did not go completely into the median, and its trailer was partially in the roadway. A third eighteen-wheeler collided with the second, causing the driver of the second truck, who had been attempting to untangle his vehicle from the metal cables, to get hit by his truck. It took the Mississippi Department of Transportation hours to remove the wreckage from the roadway, especially the truck that had gone into the woods. Several trees had to be cut down for that vehicle to be removed from the accident scene.

Accidents involving tractor trailers often cause more property damage and more severe injuries than accidents where only passenger vehicles are involved. When two or more tractor trailers are involved in an accident, the stakes are even higher. The risk for accidents involving multiple tractor trailers is highest during morning and evening commute times when roads are most crowded. There are many ways in which other tractor trailers can pile onto a wrecked tractor trailer. For example, a tractor trailer can rear-end a wrecked eighteen-wheeler, or it can collide with another vehicle as the driver tries to navigate around a wreck.

The aforementioned accident resulted in minor injuries, but many other crashes that involve more than one eighteen-wheeler lead to severe injuries and sometimes even one or more fatalities. Since any accident involving a tractor trailer also involves the trucking company that owns the truck, accidents involving multiple tractor trailers can quickly become complicated and difficult to resolve because of the number of parties – drivers, passengers in trucks and other vehicles, trucking companies and insurers involved. Anyone who was involved in an accident involving multiple tractor trailers will benefit from seeking assistance from a Mississippi Trucking Accident Attorney who can help them navigate the complexities of a multi-party claims process.

A recent tractor trailer crash on I-55 claimed the life of one man, the truck’s driver. The early morning accident occurred when the truck, which was hauling a double trailer, left the roadway and collided with a tree. Tractor trailer accidents can cause serious injury or death and significant amounts of property damage. If you were hurt or if someone you love got killed in a tractor trailer wreck, it is important that you understand how tractor trailer accidents differ from accidents involving one or more non-commercial motor vehicles.

Tractor trailers have a size and shape that is unique among vehicles that travel along the roadways where you drive. They handle differently than passenger vehicles and specialized training and licensing is required for a driver to have permission to drive them. It is not surprising, then, that they collide with other vehicles or objects in a way that is similar to yet slightly different from other types of vehicles. To truly understand what may have happened during an accident involving a tractor trailer, the accident scene and evidence from the accident scene must be assessed by officials and others who have experience in examining tractor trailer accident scenes. The evidence in a trucking accident includes business records, cargo, and other items that are not a part of most other motor vehicle accident cases. Trucking accident attorneys understand how tractor trailers work, the types of malfunctions that can occur as they travel along the road, and the ways in which they can move during collisions.

When an accident involves a tractor trailer, there are more parties involved in the crash than may meet the eye. In addition to the drivers and passengers who were directly involved in the accident, the company that owns the truck as well as that company’s insurer are all parties to the wreck. This can make for a complicated set of facts, but it can also provide more avenues from which plaintiffs can recover for their injuries or losses. Trucking accident attorneys understand how the various parties in trucking accident cases are related to each other and they know how to engage with each of the types of individuals and business entities involved in your trucking accident case.

A recently filed wrongful death lawsuit claims that a component of the braking system of a tractor-trailer caused a deadly crash when it failed. The accident, which occurred in 2015, killed a woman and injured her infant son. The wrongful death lawsuit was brought against the manufacturer of the brake part, Meritor WABCO Vehicle Control Systems, and other parties.

The lawsuit claims that the brake part has undergone forensic testing and that test results show that the Meritor modulator valve was defective, as defined by Alabama law, at the time of the accident. The plaintiff in the lawsuit, the husband of the deceased and the father of the injured child, seeks compensatory and punitive damages for her wrongful death, product liability, negligent and wanton maintenance of the tractor trailer, and failure to warn of defects.

Tractor trailers are designed to be driven long distances on a regular basis. Because of this, the safe operation of any tractor trailer involves regular checks of all of the parts of both the tractor and the trailer. Many components of a truck wear out fairly quickly, and must get replaced on a regular basis, so regular checks ensure that worn out parts get replaced before they fail on the road. If a part fails while the driver is on the road, an accident could occur.

Sometimes safety checks are not performed regularly, or repairs are not made as soon as they are needed and accidents occur. Sometimes these checks are done by the driver of the truck and at other times, mechanics inspect the trucks. At other times, accidents happen when parts fail without any warning or in spite of vehicle checks that could not reveal the defect that caused the crash. When a tractor-trailer is involved in an accident which may have been caused by a mechanical defect, multiple parties could each be partially or fully responsible for the injuries and the damages that were caused by the crash. When there are multiple defendants, the lawsuit can become rather complicated as the parties try to blame each other for the accident and absolve themselves of responsibility for as much of the damages as they possibly can.

Barrett Law PLLC:  Helping Mississippi Trucking Accident Plaintiffs and Their Families

Trucking accident cases involving mechanical defects can be lengthy and complicated. Accident victims and their families may be kept waiting for much-needed compensation while the potentially responsible parties point fingers at each other and argue over who is responsible for how much of the damage that was caused by the crash. This can be frustrating for accident victims and their families, but they do not have to go through it alone. If you were injured or someone that you love was killed in a trucking accident where there may have been a mechanical defect, Mississippi Trucking Accident Attorneys could help you navigate the complicated trucking accident claims process so that you can devote your time and energy to healing your injuries or recovering from your loss. A recent crash involving a school bus and one other vehicle recently blocked both lanes of traffic on Highway 57 in Jackson County for a few hours. The Mississippi Highway Patrol reported that there were students on the bus when the accident occurred. Fortunately, there did not appear to be anyone injured.

School bus accidents do not always end as safely as this one did. Last year, there was a school bus rollover accident where students were injured, and some school bus accidents do result in serious injuries and even death. Whenever there is a school bus accident, it is not surprising that parents think about whether they are doing the right thing when they send their kids out to catch the bus to school every weekday morning. Fortunately, school bus accidents are not all that common, and research indicates that they are in fact the safest way for kids to get to and from school. Riding to school in a private vehicle is actually seven times more dangerous than riding to school in a school bus.

If you can think back a few years to when you were in school, and you rode the school bus, you might remember that there were not any seat belts on the buses. You might think that certainly, school buses would have seat belts now, especially with all of the focus on car seats for children up to ages that are well beyond the ages that children were required to use them when you were younger. It might surprise you, then, to learn that in most places, there are still not any seat belts on school buses. This is not an oversight; it is actually a deliberate choice by school bus manufacturers who have studied many different types of school bus design and have decided that the no-seatbelt design is the safest for a few reasons.

School buses are designed to keep passengers safe in a much different way than other types of passenger vehicles like cars and SUVs are. School buses are made with padded, high-backed seats. These seats serve a purpose – they divide the interior of the bus into compartments, which reduces the amount of passenger movement during collisions. The large size of a school bus distributes any impact from a collision across a wide area. These and other design features help to keep kids safe on school buses, and parents can feel good about that.

A pedestrian recently got hit by an eighteen-wheeler. The man suffered two broken legs, among other injuries. The accident occurred on the I-55 North in Canton. It is not very often that accidents happen involving pedestrians and tractor trailers. This accident shows the importance of understanding the difference between trucking accidents and regular motor vehicle accidents because accidents involving tractor trailers can occur whether you are in your car or you are walking.

The aforementioned accident occurred along a busy highway, which is not a place where most people would be walking. However, tractor trailers travel along plenty of roads where people do walk. In areas where there is any pedestrian traffic, the risk for automobile-pedestrian collisions is present. The number of motor vehicle accidents involving pedestrians is on the rise, and automobile crash researchers believe that distracted driving may be at least partially to blame.

When a motor vehicle strikes a pedestrian, the driver of the vehicle is likely to be found to have been at fault for the accident. There are a few ways in which pedestrian accidents often happen. Sometimes, a driver makes a turn as a pedestrian is crossing the street in a crosswalk. At other times, a driver who is under the influence of drugs or alcohol may collide with a pedestrian that they do not see because of their condition. Drivers who run red lights or stop signs also run the risk of striking a pedestrian who is crossing the road at the intersection. Vehicles entering the roadway from driveways sometimes do not notice pedestrians who are approaching, and pedestrian accidents happen this way, as well.

When an automobile strikes a pedestrian, it is highly likely that death or serious injury will occur, especially if the vehicle involved is a tractor trailer. When a person has been seriously injured or killed in a pedestrian accident, there are a few types of legal actions which may be filed against the driver and, if it is a commercial vehicle like a tractor trailer, the trucking company, by various parties.

For example, the State can file criminal charges against the driver if they were violating any laws at the time of the accident. Another type of action that may be filed against the driver of an automobile who has struck a pedestrian is a claim for injuries and damages. These claims are the type of claims that are usually filed by the victims of car accidents against the driver’s insurance company, for the purpose of obtaining financial recovery for the injuries and damages that they have sustained.

A recent accident involving three tractor trailers and other vehicles claimed the life of a UPS truck driver. The accident occurred on Interstate 20 in Newton County. The driver of one of the trucks and his passenger got hurt in the wreck, and the driver of the third eighteen-wheeler was not injured. This accident started out with one rear-end collision, and a third truck crashed into the back of the second truck. The driver who died in the crash was driving the third truck.

Tractor trailer accidents are often both severe and fatal. Because eighteen-wheelers are so large and so heavy, any accident involving one or more of them can cause fatalities, serious injuries, and massive amounts of property damage. Unfortunately, accidents involving multiple tractor trailers can happen at any time. However, the risk of those accidents happening is higher during morning and evening commute times, when the roads are crowded with trucks and other vehicles. When trucks are traveling near each other, there are several ways that they might collide with each other. Sometimes, as happened in the accident mentioned above, one eighteen-wheeler rear-ends another and sometimes other trucks or vehicles hit with the first two trucks. These rear-end collisions often cause a lot of damage to the trucks. Also, the driver of the truck that collides with the rear of the first truck can become trapped in the cab of their truck, resulting in serious injuries or death from injuries, fire, or an explosion. Pile-up or chain reaction accidents are another way in which multiple eighteen-wheelers can collide. Side impact accidents are another possible multiple-truck accident scenario, especially when tractor trailers are driving close to each other.

Whenever there is a trucking accident, there is often a complicated set of facts. This can make it difficult for accident victims and their families to pursue claims for damages. The reason for the complexity is that trucking accidents involve more parties than the drivers and any passengers who may be at the accident scene. Some tractor trailers are driver-owned, but many others are owned by trucking companies and are covered by commercial insurance policies. The trucking company and insurance company are parties who have interests in the outcome of the accident investigation, so whenever an eighteen-wheeler gets into a wreck, the trucking company calls its insurer to notify them of the crash and the insurer often immediately dispatches a team of investigators to the accident scene.

The “accident response teams” that respond to accident scenes on behalf of insurers and trucking companies are not neutral parties. If you are ever at the scene of a trucking accident, remember that those individuals represent interests that may be contrary to yours. You are free to refuse to speak with them until you have consulted an attorney.

A dump truck driver went missing after the truck he was operating slid down a slope and into a river. The man was picking up slag rocks off of barges when the accident happened. Rescue crews with boats worked through the night trying to locate the driver in the water, and search and rescue teams continued to look for him as the investigation into why and how the dump truck rolled into the river began.

Dump truck operators face dangers on the job every day. When an accident occurs, there is great potential for serious injury or death. Dump truck accidents can happen in ways that are as varied as the work that dump truck operators do. For example, an accident in a landfill resulted in the death of a dump truck driver who was buried underneath several tons of construction materials that were dumped on top of him and on top of his truck by another dump truck operator.

Dump truck operators can be injured or killed in accidents on roadways, in the same manner that drivers and passengers in other types of vehicles can. When dump trucks are present at construction sites, there is always a danger that a dump truck operator who is outside of their truck could be struck by another dump truck as it passes through the site. Loading and unloading create other situations in which a driver may be outside of their truck and at risk for rocks, dirt, rubbish, and other materials to fall on them, which could injure or kill them. Other dump truck accidents occur near waterways, in quarries, or in other areas where the ground underneath where the trucks are working creates a hazard of tipping, falling, or other unexpected movements of the truck, which can hurt and kill the driver.

Accidents involving dump trucks are similar to other types of trucking accidents in that dump trucks are often owned by trucking companies and insured with commercial insurance policies. Accidents involving dump trucks can involve a lengthy and complicated claims process involving multiple parties. A dump truck accident can leave a driver seriously injured and facing lost work time as well as a long recovery.  A dump truck accident could also rob a family of a loved one suddenly and without warning. Both of these situations make it difficult for those with personal injury or wrongful death claims to pursue them.

Because of the complexity and sophistication involved in trucking litigation, the experience, skill, and legal acumen of the Jackson trucking accident attorneys you handle can have a profound impact on your recovery.  This blog post is the second installment providing recommended issues to consider when hiring a semi-truck accident lawyer.

What other evidence will the law firm use to prove the liability of the commercial driver and trucking company?

Our law firm will use all appropriate evidence and tools to establish the negligence of the trucking company and driver.  Our Mississippi tractor-trailer accident attorneys aggressively use discovery to obtain documents and information that include but are not limited to the following:

  • Electronic data recorder information
  • Fuel and tire receipts
  • Lodging receipts
  • Emails between driver and trucking company
  • Employee personnel file
  • Drug testing records
  • Driver logbooks
  • Maintenance records
  • Documents related to safety inspections and violations

We also work closely with industry experts regarding engineering and handling issues, accident reconstruction, and industry practices.  Our lawyers also use documents obtained in discovery, as well as the testimony of company officials and the driver to uncover manipulated records like false logbook entries.

Has your law firm had success in prior tractor-trailer accident lawsuits?

Law firms that have successfully handled prior trucking accident cases should be able to reference prior significant settlements and judgments.  While no two cases are identical and past results cannot guarantee any specific result in your lawsuit, a firm that has expertise handling trucking cases will be able to talk to you about prior results in prior tractor-trailer accident cases.

How do your trucking accident attorneys handle client customer service?

If you were hiring a contractor to renovate your home, you would not select someone who puts your project on the backburner and neglects to communicate with you about the progress of your home.  Clients should expect no less when hiring a lawyer for your trucking case.  We place a high value on client satisfaction which is why we have a policy of responding to phone calls or emails the same day or the next business day.  Our lawyers also provide updates regarding significant developments in your case, so you are not left in limbo regarding the status of your legal claim.

How will your law firm prove damages suffered in my trucking accident claim?

If a passenger vehicle occupant is injured in a collision involving an 18-wheeler, there is a high probability that occupants of the passenger vehicle will suffer severe injury.  We will use your medical records and billings, payroll records, vehicle repair/replacement estimates, and similar documents to establish your economic losses.  Our attorneys also use testimony from trucking victims and family members to help a judge and jury understand the impact of your injury or disability on your daily life experience.  We also might use medical experts and vocational therapists to help prove the limitations and obstacles you face in working or engaging in activities before your injuries.  Since the types of severe injuries experienced in a tractor-trailer crash can adversely impact many aspects of your life, we rely on these types of evidence, videos, and other evidence to facilitate a verdict or settlement that fully addresses your losses.

Does your law firm have the financial resources necessary to successfully pursue my personal injury claim?

When litigation involves complex issues like those in trucking accident litigation, as well as catastrophic injury or wrongful death, the cost of litigating the case typically will be significant.  The litigation could be a lengthy process even without a trial.  Further, experts might need to be paid for their time testifying in depositions and at trial.  Effective use of specialized testimony from expert witnesses, persuasive professional visual exhibits/videos, and other successful litigation tools can mean the difference between a successful and a sub-par outcome.  Reputable trucking accident law firms will advance the costs of your litigation, so you need to know that the firm you retain has the litigation resources to maximize your chances at a full recovery.

If you have been injured in a semi-truck accident in Mississippi or the surrounding areas, our Jackson trucking accident lawyers have successfully represented many victims of negligent commercial carriers and their drivers.  At Barrett Law, our Mississippi Trucking Accident Attorneys are here to help.  Contact our law firm today at 800-707-9577 to schedule your free consultation, so we can answer any questions you may have regarding filing your claim.
