Defects and malfunctions are a factor in close to five percent of all fatal crashes involving tractor-trailers.  While there are many vehicle-related issues that can contribute to a trucking accident, unsafe brakes constitute one of the most dangerous types of malfunction that can cause a large truck to collide with other vehicles.

Since semi-trucks are much heavier than passenger cars, vans, and pickups, truck drivers require a much longer time to stop when confronted with a road hazard.  Because of their size and weight, large trucks are equipped with a different type of braking system than passenger cars.  Generally, large trucks come equipped with compressed air brake systems whereas passenger cars rely on hydraulic brake systems.

A compressed brake system is comprised of several components, including an air compressor driven by the engine, control panels, a compressed air storage tank, services brakes, and parking brakes.  When a truck driver pushes down on the brake pedal, pressure is generated and propelled into the brake chamber.  The air slows the rotation speed of the wheels of the tractor-trailer.  Although this type of braking system is more efficient at reducing the speed of heavier vehicles, air brake systems can fail without adequate and timely maintenance.  When air brakes on a large truck fail, the prospect of an 80,000 pound vehicle streaking down the highway out-of-control can be a terrifying sight.

The vast majority of tractor-trailers are equipped with a backup braking system designed to avert collisions when a big-rig cannot stop or slow properly.  Despite this form of redundancy and the general reliability of air brake systems, trucking accidents involving brake failure cause a significant number of motor vehicle accidents.  In most instances, the brakes fail on a large truck because the operator’s driving places too much stress on the brakes, or the driver fails to properly engage the braking system.

While most motorists are well aware of the inherent risk posed by intoxicated and distracted drivers, drowsy driving receives much less attention.  Despite the devastating impact of severe fatigue and drowsiness on the physical and mental skills needed to safely operate a motor vehicle, the issue of drowsy driving has been largely ignored by lawmakers.  The expansive use of prescription and over-the-counter drugs that promote drowsiness threatens to make the problem even worse.

Drowsy driving accounts for a significant number of serious crashes that cause debilitating injuries, such as traumatic brain injuries (TBIs), spinal cord injuries, broken bones/fractures, internal organ damage, and even fatalities.  According to data from the National Highway Traffic Safety Administration (NHTSA), approximately 100,000 crashes occur every year that involve sleep deprivation as a factor.  The National Sleep Foundation reports that sleep-deprived drivers account for approximately 1,550 fatalities and 71,000 injuries annually.  The organization also reports the economic cost associated with these crashes exceeds $12.5 billion annually.

  • Inaccurate State Reporting Systems: While states have adopted fairly standardized techniques for reporting the causes of accidents, these systems are not effective for drowsy driving.  States tend to have different reporting systems for this type of unsafe driving practice with some states not even documenting sleep deprivation as a potential cause of an accident.
  • Lack of Objective Testing: When drivers are operating motor vehicles under the influence of intoxicants like drugs or alcohol, there are objective tests that can be applied, such as a chemical test of blood, breath or urine.  There is no comparable test to determine if a driver was falling asleep behind the wheel.
  • Inherent Self-Reporting Issues: Drivers cannot be expected to accurately self-report drowsiness as a factor in causing an injury accident or fatal collision because of concerns about civil and criminal liability.

Along with these factors that complicate attempts to get an accurate fix on the scope of the drowsy driving epidemic in the U.S., evidence from other countries with better reporting systems suggest the problem could be as significant as drunk driving.  A study that evaluated crash data involving collisions in a number of European counties found that drowsy driving could be a factor in as many as thirty percent of all collisions.  While this estimate might seem alarmingly high, a study conducted by the organization Sleep in America found that 27 percent of participants admitted to commuting to work when drowsy at least a few times per month.

Recently, a teenage Mississippi boy was killed in an ATV accident. A tragic accident in Greene County, Mississippi on June 24, 2014 resulted in the loss of two local paramedics.  The paramedics were responding to an emergency medical call around 11 a.m.  While traveling on Highway 63 in the Sand Hill Community, an 18-wheeler hauling a bulldozer took a left turn in front of the approaching ambulance.  The 18-wheeler and the ambulance collided, causing both vehicles to burst into flames.  Both paramedics, Alan Smith and Dennis Rushing, died in the accident.  The driver of the 18-wheeler, who has been identified as 47 year old Charles E. Bexley of Beaumont, Mississippi, was transported to the hospital for treatment of minor injuries.

While the accident is still under investigation, Brent Barfield of the Mississippi Highway Patrol has publically stated that the ambulance had the clear right of way because the paramedics were responding to a medical call.  The speed with which ambulances are able to make it to the scene of a crisis is extremely important to the individual 911 callers and the public as a whole.  Brent Barfield, Trooper 1st Class, knew the victims personally and emphasized the need to recognize the efforts and heroism of paramedics every day.

There are many serious injuries that may result from a car accident, but the loss of mobility that comes from a knee injury is all-too-common.  Most people do not think about the impact that a knee absorbs every day until damage to the joint leads to an inability to carry out the most basic activities, such as taking your child to the park or driving to work.  When that harm is caused by the negligence of another driver, it is important to ensure that any settlement or award covers the lengthy recovery process and any future surgeries that may be necessary.

  • Ruptured tendons; and
  • Dislocation of the knee.

The National Highway Transportation Safety Administration (NHTSA) is responsible for investigating claims of dangerous faults in motor vehicles in the United States.  Over the past few months, there have been many different problems with vehicles on the road across the country that have been featured on the front pages of nearly every major print news source.  General Motors has faced a number of serious allegations after purportedly mishandled recalls that led to serious accidents and more than a dozen deaths.  Now, a consumer complaint has prompted the NHTSA to investigate potential braking problems in the Chevrolet Impala.

The consumer complaint that led to the NHTSA investigation was that the 2014 Impala has a defect that leads to the activation of the emergency braking system without warning.  The complaint states that the activation of the braking system led to a sudden stopping of the car when it was traveling at 40 miles per hour, which led to the vehicle being rear-ended.  The complaint prompted the NHTSA to investigate whether the defect is widespread throughout the more than 60,000 2014 Impalas on the road.  If the investigation does lead to a determination that there is a widespread defect, then the NHTSA can trigger a recall.

Generally, when the NHTSA has determined that there is a vehicle flaw that impacts many cars or trucks because of a design or manufacturing defect, it may determine that the nature of the hazard necessitates a widespread recall and issue an official order.  However, the auto manufacturer may challenge the NHTSA in a federal district court.  While the car manufacturer has the right to challenge the order, the NHTSA has the right to go to court to enforce the order and compel the recall.  Once a case has been filed by either the NHTSA or the car manufacturer, the burden lies with the agency to prove that there is a defect that warrants the recall because it poses a serious threat to the safety of consumers.  Depending on the circumstances, even though the auto manufacturer is contesting the finding of the NHTSA that there is a safety risk from the defect, they may need to send notice to all consumers in possession of the potentially dangerous vehicle about the alleged hazard.

            Although the NHTSA is empowered to order a recall if an official investigation reveals a defect that is present in many vehicles, the auto manufacturer may choose to recall specific vehicles based on its own findings without agency intervention.  The auto manufacturer should have learned the relevant facts through:

  • Internal testing protocols;
  • Vehicle inspection policies;
  • Analysis of information gathered through a number of data systems; and
  • Review of all facts in a comprehensive and organized process.
